Likeness Policy
What you accept when you upload a real reference photo to create a Cladegrove character. Read this in full before uploading.

1. What this page covers
Cladegrove allows you to upload a reference photo when creating a character so the generated card image preserves a real likeness. This page describes the rules that apply to any image you upload through that flow and the responsibilities you take on by doing so. It is binding alongside the Terms of Service and the Privacy Policy.
Characters created from text only (modes text_free and text_guided) are not covered by this page. They are governed by the standard Terms and the Acceptable Use rules.
2. You assume full responsibility
When you upload a reference photo, you alone are responsible for the uploaded material and for any output derived from it. Cladegrove is a processing tool: we provide the AI infrastructure, but the choice of source material, the legal basis for using it, and the use of the generated outputs are entirely on you.
By submitting a reference photo and clicking the consent checkbox in the character wizard, you confirm and warrant the following:
- Identity. The photo depicts you, or it depicts a third party who has given you explicit, informed and revocable consent to use their likeness for AI generation through Cladegrove.
- Adulthood. The subject of the photo is an adult (18 or older). Uploads depicting minors are strictly prohibited and will be removed and reported where required by law.
- Rights. You own, or have a sufficient licence to, every right necessary to upload the photo and to have it processed by an AI image model, including any image-rights, model-release, personality-rights, copyright or database rights that may attach to the photo.
- No public-figure exploitation. The photo does not depict a public figure, celebrity, politician, athlete or other third party with the purpose of impersonation, defamation, commercial endorsement or political content.
- No unlawful intent. You will not use the resulting character to produce sexual, defamatory, harassing, deceptive or otherwise unlawful content involving the depicted person, and you will not present the outputs as authentic photographs of that person.
To keep the Service safe and respectful, sexual, NSFW or otherwise policy-violating requests are blocked automatically before any image is produced and the Credit is refunded; this enforcement does not limit your own responsibility for the material you upload.
3. Indemnification
You agree to defend, indemnify and hold harmless Cladegrove, its owner Fabio Ariotti, its sole proprietorship and its service providers from and against any claim, demand, loss, damages, costs or expenses (including reasonable legal fees) brought by any third party, including the depicted person, their heirs, their employer or any rights-holder, that arises out of or relates to a reference photo you uploaded, the consent you declared, or any output derived from it.
This indemnity survives termination of your account and the deletion of the relevant character.
4. What we do with the upload
The reference photo is stored in a private storage bucket inside our infrastructure (Supabase, EU region). It is never made publicly accessible: every read goes through a short-lived signed URL minted server-side. The photo is sent to Google (Gemini Developer API, gemini-3.1-flash-lite) to extract the character anatomy, and to OpenAI (gpt-5.5 via the Responses API with the image_generation tool, which preserves the uploaded face while the studio composition is driven by our prompt) to produce the studio card image, and only for the duration of those calls.
The upload is retained for as long as the related character exists, so a Regenerate of the card photo can keep the same likeness anchor. When you delete the character, or your account, the upload is deleted from our storage as part of the same operation.
The acceptance of this policy is logged for audit purposes (Art. 7 GDPR) with the timestamp, your IP and your user-agent. The log is part of the data export available under Art. 15 GDPR.
5. AI Disclosure still applies
Every image produced by Cladegrove, including the studio card generated from your reference photo, is a synthetic image produced by an AI model. Images created through the photo-upload flow (mode photo_upload) carry the same provenance markers as any other Cladegrove output: a SynthID watermark embedded in the pixels by the upstream OpenAI model and IPTC/XMP provenance metadata written by Cladegrove into the file before storage. See the AI Disclosure page for the full technical description and for how to verify them. These images must not be presented to third parties as an authentic photograph of the depicted person.
When you publish or share a Synthetic Output that could be perceived as an authentic photograph of a real person, you remain responsible for adding a clear and visible label disclosing its AI origin (Art. 50(4) of the EU AI Act).
6. Reporting and takedown
If you believe a character or output on Cladegrove was created from a photo of you without your consent, or otherwise violates this policy, contact us at privacy@cladegrove.com. Provide a description of the relevant character or generation and a reasonable proof of identity (so we can confirm the takedown is authorised). We will remove the affected character and the related upload within 7 days of verification and, in cases of policy violation, terminate the offending account.
7. Changes to this policy
We may update this Likeness Policy when the upload feature evolves or when the legal landscape changes. Material changes are versioned in our codebase (see LIKENESS_POLICY_VERSION) and a fresh acceptance is required before the next upload. Continued use of the Service does not silently re-confirm a prior acceptance.
